§1 Scope of application
The following terms and conditions apply to orders and contracts
between us and a consumer

These terms and conditions are important for both parties, as they define what we can expect from each other. They also provide useful information about the order process and fulfilment. Deviating terms and conditions are not recognised unless they have been set out in writing.

§2 Conclusion of the contract
2.1 The presentation of the products on the jeannesousan.com website does not constitute a legally binding offer, but a non-binding presentation of models.
2.2 By successfully completing the order process, the customer submits a binding offer and recognises these terms and conditions as binding.
2.3 By sending the order confirmation, the customer is informed that the order has been received.
2.4 The supplier accepts the contract by delivering the goods.

§3 Subject matter of the contract
The subject of the contract is the sale of individually manufactured goods.

§4 Prices and shipping costs
4.1 The prices listed in the order confirmation include the applicable statutory VAT, which is shown on the invoice.
4.2 The shipping costs are stated separately for the respective order on the order confirmation during the order process
4.3 If the delivery is made to a country outside the EU, the customer may incur additional costs in the form of customs duties and taxes, which must be paid to the respective authorities.

§5 Terms of payment
5.1 Payment for the goods is always made in advance. The payment options listed in the order process are accepted as payment methods.

§6 Production times / delivery times
6.1 The time for the production of a model is communicated to the customer in the model description. This is an estimate that is to be calculated from the time the order confirmation is signed.
6.2 The customer shall be informed in writing of any deviations. These may arise, for example, if a fabric is not in stock.
6.3 Production times do not include the delivery times of the transport company.
6.4 Models labelled as ‘add to bag’ will be dispatched within 4 working days of receipt of payment.

§7 Revocation / Returns / Cancellation
7.1 Our models are individually manufactured goods for which no right of cancellation can be granted.
7.2 As soon as the payment amount has been booked and we start work, we can no longer cancel orders.
7.4 It goes without saying that customised products cannot be exchanged.
7.5 The only exception to this are the models that we already have completed in stock.
These can be returned within 8 days of receipt, with prior written notification. Please contact us by e-mail to arrange the return.
We can only accept prepaid returns. The goods must be in exactly the same condition as at the time of despatch. They must not have been used. There must be no marks from trying on the models.

§8 Colours / fabric qualities
Some antique fabric qualities are used. These may have small blemishes, stains or brittle areas. These are not faults to be criticised, but rather characteristics of authenticity and genuineness.
Colours are displayed differently depending on the monitor. For an optimal impression of your chosen fabric quality, we offer to send you small fabric sections.

§9 Warranty
9.1 The statutory regulations on liability for defects apply.
9.2 We do not check the data provided by you for correctness of content and therefore accept no liability for errors. The body measurements you provide us with can be measured on the model. If, for example, you give us a waist of 72 cm and increase to 76 cm by the time your model is delivered, this is not a defect that allows you to withdraw from the contract.
9.3 No liability is accepted for incorrectly handled models. Please inform yourself about the correct handling, care and cleaning options for your model.
We will be happy to advise you.
9.4 The consignment must be checked immediately for defects or transport damage, which must be reported to the transport company.

§10 Copyright law / right of use
The designs shown and supplied are protected by copyright. Reworking, imitation or copying is not permitted, even in extracts or based on the original. 
In the event of infringement, §31 of the Copyright Act / Infringement of Rights of Use shall apply.

§ 11 Choice of law
German law shall apply. In the case of consumers, this choice of law shall only apply insofar as the protection afforded by mandatory provisions of the law of the state of the consumer’s habitual residence is not thereby withdrawn (principle of favourability).

§12 Severability clause
Should individual provisions of this contract be or become invalid or contain a loophole, this shall not affect the validity of the remaining provisions.
